FoneGo Terms and Conditions

Preamble
A. These Terms and Conditions ("Terms") govern your use of the FoneGo application ("App") and related services ("Services") provided by FLECAM FLEX LTD ("we," "us," or "our"). Please read them carefully before using the App or Services.
B. We reserve the right to modify these Terms at any time at our sole discretion. Changes will be posted within the App, and your continued use constitutes acceptance of the updated Terms.
C. Amendments become effective upon posting. You are responsible for reviewing the Terms regularly to stay informed of updates.
1. License Grant
1.1 The App and Services are owned and operated by FLECAM FLEX LTD.
1.2 Subject to your compliance with these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to use the App and Services for personal, non-commercial purposes.
1.3 Except as expressly granted herein, no intellectual property rights in the App are transferred to you. This license terminates automatically upon your breach of these Terms.
1.4 Copyrights and all other intellectual property rights in the App are owned by FLECAM FLEX LTD or its licensors.
2. Eligibility and Use
2.1 The App and Services are available only to individuals aged 18 or older who are legally capable of entering binding contracts.
2.2 You may print materials from the App for personal use only. Any reproduction, redistribution, or dissemination without our prior written consent is prohibited.
3. Acceptable Use
You agree not to use the App or Services:
(1)For unlawful, fraudulent, or malicious purposes (including hacking, introducing malware, or phishing);
(2)To infringe intellectual property rights;
(3)To transmit defamatory, offensive, or objectionable content;
(4)To disrupt, overload, or damage our systems or security;
(5)To interfere with other users’ experience; or To use automated tools to access, monitor, or copy content without our prior written consent.
4. Your Responsibilities
4.1 You must obtain and maintain all necessary devices and connections required to access and use the App and Services.
4.2 You are responsible for the performance and security of your devices. We are not liable for errors or failures due to device malfunction, viruses, or related issues.
4.3 You must comply with all instructions, procedures, and terms provided in these Terms and related documentation.
4.4 You are solely responsible for safeguarding your login credentials and device security. We are not liable for unauthorized access resulting from your failure to protect such information.
4.5 You must follow our security protocols and ensure that only authorized individuals use the Services.
5. Modification and Termination
5.1 We may, at any time and with notice, suspend, terminate, or modify your access to the App and Services. Outstanding amounts under any installment agreement must be settled within the specified period.
5.2 We may suspend access immediately, without notice, in cases of suspected fraud, breach of Terms, unauthorized use, legal compliance, technical or safety reasons, or for business or operational needs.
5.3 Termination does not affect any rights or liabilities that have accrued prior to termination.
6. Service Availability
6.1 Access may be unavailable or limited due to circumstances beyond our control, including hardware/software failure, network overload, force majeure events, utility failures, labor disputes, or government restrictions.
6.2 While we strive to minimize disruptions, we are not liable for any loss or damage resulting from service interruptions, delays, or limitations.
7.Limitation of Liability
7.1 The App and all Services are provided on an "as is" and "as available" basis, to the maximum extent permitted by applicable law.
7.2 We are not liable for delays, usability issues, viruses, compatibility problems, or other difficulties arising from causes beyond our reasonable control.
7.3 We do not guarantee the accuracy, completeness, or reliability of content on the App and disclaim liability for errors or omissions.
7.4 We are not liable for losses resulting from:
(a) Fraudulent or illegal use of the Services, App, or your devices;
(b) Your failure to comply with these Terms or related instructions.
7.5 If Services are disrupted for reasons not specified in Clause 6.1, our sole obligation is to restore Services as soon as reasonably possible.
7.6 Except as stated herein, we are not liable for any unavailability or interference with the App or Services.
7.7 We are not liable for losses due to third-party fraud. You agree to indemnify us against losses arising from unauthorized transfer of installment repayments. You must take reasonable steps to ensure repayments are made only to our designated account and notify us immediately of any unauthorized activity.
8. Notices
8.1 Written notices to us should be sent to: flecamflex@fone-go.co or another address we designate. We will acknowledge receipt via email.
8.2 We may notify you by posting within the App, or via email or SMS to the contact details you provided upon registration.
9. General Provisions
9.1 No failure or delay in exercising a right under these Terms constitutes a waiver. Partial exercise of a right does not preclude further exercise.
9.2 If any provision is held invalid or unenforceable, the remaining provisions remain in full effect.
10. Governing Law and Dispute Resolution
10.1 These Terms are governed by and construed in accordance with the laws of Ghana.
10.2 The parties shall attempt in good faith to resolve any dispute amicably.
10.3 If resolution is not achieved, disputes shall be submitted to the exclusive jurisdiction of the courts of Ghana. Both parties irrevocably submit to such jurisdiction.
